CALGARY ROUGHNECKS® LIMITED PARTNERSHIP and COUNTRY 105

1. THE CONTEST AND THE CONTEST PERIOD

 

Roughnecks Karaoke contest (the “Contest”) commences January 11, 2010 5am and concludes at halftime on April 10, 2010 game between the Calgary Roughnecks® and the Colorado Mammoth (the “Contest Period”).

2. NO PURCHASE NECESSARY

 

ELIGIBITY

The Contest is open to residents of Alberta, who are eighteen (18) years of age or older, but excluding employees, directors and officers of CKRY-FM, Corus Entertainment Inc. (“Corus”), any affiliate (as defined in the Canada Business Corporations Act) of CKRY-FM or Corus (the “Affiliates”), employees, directors and officers of, the Calgary Roughnecks® Limited Partnership (the “Roughnecks”), employees, directors and officers of their respective advertising and promotional agencies, as well as family members of any of the foregoing. The Contest will also exclude any persons who have a current, previous or scheduled recording contract with any record company.

3. HOW TO ENTER AND WIN

 

Go online to www.country105.com (the “Website”) and submit a video or audio of you singing a song during the Contest Period; accapella, with a guitar, or with a band. CKRY-FM and the Roughnecks will pick the top three (3) semi-finalists for each of the first rounds oft he Contest.

The first phase of the first round of the Contest will take place at halftime on January 23, 2010. Video or audio uploaded submissions will be accepted until 10:00am on January 15, 2010. The Top three (3) semi-finalists will be announced in the drive show by 6:00pm on January 15, 2010 by Roger Rhodes of the Rhodes Show. The Top three (3) semi-finalists will be contacted by 1:00pm on January 18, 2010 by the CKRY-FM Promotions Department. Only those contacted will be included in the final selection. The Finalist from the first phase will be determined and contacted at halftime on January 23, 2010.

The second phase of the first round of the Contest will take place at halftime on February 14, 2010. Video upload submissions will be accepted until 10:00am on February 5, 2010. The Top three (3) semi-finalists will be announced in the drive show by 6:00pm on February 5, 2010 by Roger Rhodes of the Rhodes Show. The Top three (3) semi-finalists will be contacted by 1:00pm on February 8, 2010 by the CKRY-FM Promotions Department. Only those contacted will be included in the final selection. The Finalist from the second phase will be determined and contacted at halftime on February 14, 2010.

 

The third phase of the first round of the Contest will take place at halftime on March 13, 2010. Video upload submissions will be accepted until 10:00am on March 5, 2010. The Top three (3) semi-finalists will be announced in the drive show by 6:00pm on March 5, 2010 by Roger Rhodes of the Rhodes Show. The Top three (3) semi-finalists will be contacted by 1:00pm on March 8, 2010 by the CKRY-FM Promotions Department. Only those contacted will be included in the final selection. The Finalist from the second phase will be determined and contacted at halftime on March 13, 2010.

 

The second and final round of the Contest will feature the Finalist of each phase of the first round of the Contest. The second round of the Contest will take place at halftime of the game on April 10, 2010.
On April 10, 2010, one (1) eligible Finalist will be declared the Grand Prize winner.

All semi-finalists in the first three phases in the first round of the Contest will be judged by crowd applause after all three (3) semi-finalist have concluded their respective performance. The Roughnecks will determine the Finalist with the most crowd applause. All judging decisions will be final and non-negotiable.

All Finalists in the second round of the Contest will be judged after all three (3) Finalists have concluded their respective performance by a panel of judges to be selected at the sole discretion of the Roughnecks. All judging decisions will be final and non-negotiable.

4. VIDEO REQUIREMENTS

 

Every Video and Audio entry must comply with the following requirements:

(i) must be no less than 10 seconds and no longer than 30 seconds

(ii) must be free from vulgar language or otherwise offensive material; and

(iii) must not include any unauthorized use of, or third party logos, trade-marks, or copyrighted materials.

All Videos will be reviewed before being posted on the Website. Entries will be disqualified if the entry form is not fully completed during the Contest Period, or if the Video does not conform to the Video Requirements. Contest judges reserve the right, in their sole discretion to remove any Video from the Website, or to request an entrant modify or edit his or her Video for any reason. All Videos that are deemed appropriate will be posted on the Website within 24-48 hours of submission.

5. SONG SELECTION

 

The top (3) three Finalist for each phase of the first round of the Contest will select one (1) song in accordance with the theme of the respective game to perform. Songs must be chosen upon notification of advancement. All songs are subject to approval by CKRY-FM and the Roughnecks. All songs will be chosen from a library of songs provided by the Roughnecks. Songs chosen by each individual Finalist cannot be repeated. (Eg: Achy Breaky Heart – Billy Ray Cyrus can only be performed by one Finalist.)

Finalists in the second round of the Contest may choose a new song from the library provided by the Roughnecks.

6. REHEARSAL AND PERFORMANCE REQUIREMENTS

 

There will be no rehearsals.

The (3) three semi-finalists will be invited to perform one (1) song at each of the three phases of the first round of the Contest. Semi finalists and Finalists need to be at the Pengrowth Saddledome by no later than one (1) hour before the respective game time.

The Finalist of each phase of the first round of the Contest will be invited to perform one song (1) in the second round of the Contest. In the event that the semi-finalist or Finalist is unable to attend, the Roughnecks reserve the right to substitute a runner up from any of the phases of the first round of the Contest.

Pengrowth Saddledome Access

Event level accreditation will be provided to semi-finalist and Finalist only. One (1) game ticket to the applicable Roughneck game will be given to each semi-finalist and Finalist. All accreditation is subject to standard fire and safety regulations plus Roughneck Accreditation Policy.

 

7. THE GRAND PRIZE

The Grand Prize is one (1) 46 inch Sony Bravia Television.

 

8. THE GRAND PRIZE VALUE

The approximate retail value of the Grand Prize is $1,599.

9. DEADLINE FOR CLAIMING GRAND PRIZE

 

The Grand Prize winner must claim the Grand Prize by 5:00pm on April 12, 2010 (the “Deadline”) by attending CKRY-FM’s studio at 105, 630 – 3rd Avenue SW Calgary, AB. T2P-4L4. If the Grand Prize winner fails either to claim the Grand Prize or inform CKRY-FM of his or her inability to claim the Grand Prize before the Deadline, his or her entry will be forfeited and another eligible entrant will be selected.

10. CONTENT RIGHTS

 

By entering the Contest, each entrant grants to CKRY-FM, Corus and the Roughnecks (i) the non-exclusive right and license to publish, display, reproduce, modify, edit or otherwise use the Video, in whole or in part, on the Website and/or for advertising or promoting the Contest or for any other reason; (ii) permission to use his or her first name, address, voice, likeness, statements, about the Contest and/or video or other likeness without further compensation, in any publicity or advertisement carried out by CKRY-FM, or the Roughnecks in any manner whatsoever, including print, broadcast or the Internet; and (iii) to release and hold harmless CKRY-FM, Corus, the Roughnecks and its advertising and promotion agencies, and each of their respective agents, employees, officers, directors, successors, and assigns, against any and all claims, injury or damage arising out of or in relating to participation in the Contest, and further against any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action.

11. EXPENSES

 

The Grand Prize winner is responsible for all incidental expenses incurred in claiming the Grand Prize (the “Expenses”). The Grand Prize winner understands that he or she may not seek reimbursement for the Expenses from CKRY-FM, Corus, the Affiliates, the Roughnecks or their respective advertising and promotional agencies.

12. LIMITATION ON NUMBER OF ENTRIES PERMITTED

 

Only one entry per person per household is permitted. Multiple entries will be discarded. Entries are subject to verification and will be declared invalid if they are reproduced, falsified, altered or tampered with in any way.

13. CHANCES OF WINNING

 

Chances of winning depend on the number of entries during the Contest Period.

14. NO REPRESENTATIONS OR WARRANTIES

 

Neither CKRY-FM nor Corus nor the Roughnecks makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Grand Prize. The Grand Prize winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from CKRY-FM or Corus or the Roughnecks should the Grand Prize fail to be fit for its purpose or is in any way unsatisfactory to the Grand Prize winner.

 

15. DECLARATION AND RELEASE OF GRAND PRIZE WINNER

 

Before being awarded the Grand Prize the Grand Prize winner must:

1. Correctly answer, unaided, a time-limited skill-testing mathematical question; and

 

1. Sign a standard form confirming that by entering the Contest:

1. he or she read, understood and accepted these rules and regulations;

 

1. that he or she understands that acceptance of the Grand Prize may involve danger and/or exposure to risks and hazards of both man-made and natural origin, whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he or she may suffer damage to personal property, serious personal injury, illness or even death;

1. that he or she nevertheless freely and voluntarily agrees and does hereby assume any and all risks of personal injury, illness, death arising out of or connected with his or her participation in the Contest and winning the Grand Prize; and

 

1. that he or she releases CKRY-FM, Corus, the Affiliates, the Roughnecks, and all of their directors, officers, employees, agents as well as their respective advertising and promotional agencies (collectively, the “Releasees”) from any and all liability arising in connection with participation in the Contest and acceptance of the Grand Prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from participating in the Contest or accepting the Grand Prize, whether suffered by the Grand Prize winner, or by his or her heirs, administrators, personal representatives or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence or gross negligence of any or all of the Releasees.

1. that he or she has no previous, current or scheduled recording contract with any record company.

 

16. GRAND PRIZE TO BE ACCEPTED AS AWARDED

 

The decision of the Contest judges is final, and the Grand Prize must be accepted as awarded. No portion of the Grand Prize is transferable. The Grand Prize is not redeemable for cash and no substitute for any portion of the Grand Prize is offered. Should the Grand Prize winner be unable to claim the Grand Prize as awarded, his or her entry will be forfeited and another eligible Contest participant will be selected.

17. SUBSTITUTION OR CHANGE TO THE CONTEST

 

CKRY-FM, Corus, the Roughnecks and their respective advertising and promotional agencies reserve the right to substitute the Grand Prize or any component thereof, for those of approximately the same value and reserve the right to change the Contest rules or terminate or withdraw the Contest at any time, without prior notice.

18. OWNERSHIP OF ENTRIES

 

All entries shall become the property of CKRY-FM, Corus, the Roughnecks, and their advertising and promotional agencies. The Releasees assume no responsibility for lost, stolen, destroyed or otherwise indecipherable entries due to any failure or technical malfunction of the telephone network, on-line computer systems of equipment, servers, access providers, software, poor reception, technical problems, failure of any email or submission or due to any other reason regardless of cause.

19. CONSENT TO USE OF PERSONALITY

 

By entering the Contest, each entrant, including the Grand Prize winner consents to the use of his or her name, city of residence, photograph, voice, likeness, image or any other aspect of his or her personality for any publicity and programming purposes, commercial or otherwise, in all media used by CKRY-FM, Corus, the Roughnecks, promoters and their advertising and promotional agencies, without any payment or compensation. The Grand Prize winner further agrees that his or her audio reaction may be used for on-air promotional purposes. The entrants understand and acknowledge that CKRY-FM may contact him or her on-air without prior knowledge as a result of his or her participation in the Contest.

20. CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION

 

By entering the Contest and voluntarily providing personal information including, but not limited to, name, address, city, email address, home and office telephone numbers (the “Registrant Information”), each Contest entrant grants permission to CKRY-FM, Corus and the Roughnecks to the collection and use of the Registrant Information for the exclusive purpose of administering the Contest and selecting the Grand Prize winner(s). No correspondence will take place between CKRY-FM, Corus, the Roughnecks and the entrants except in connection with the Contest and, in the case of the Grand Prize winner, as a result of entering the Contest and winning the Grand Prize.

22. COMPLIANCE WITH CONTEST RULES

All contestants agree to abide by the Contest Rules, which are subject to change at the sole discretion of CKRY-FM, Corus and the Roughnecks.

23. COMPLIANCE WITH LAWS

 

This Contest is void where prohibited by law and is subject to all federal, provincial, territorial and municipal laws and regulations of Canada and of each province, territory and municipality of Canada, respectively.
